New SuD Legislation For 2024: All You Need To Know

With the UK government’s introduction of new rules this year pertaining to drainage systems, this blog will run through what the legislation entails, and how we at Infinite Landscaping & Groundworks will ensure that your property is fully compliant.

An Introduction to SuDS

Sustainable drainage systems (SuDS) provide a more eco-friendly way of managing water around properties and developments compared to conventional drainage systems. They are designed to temporarily hold water during storms, lower peak water flows, and reduce surface runoff by imitating the natural water cycle and retaining water where it falls.

The building of new developments and groundwork around existing developments often comes with a fairly high likelihood of naturally permeable surfaces, like grass and soil, being removed, covered or otherwise obstructed during and following the building process. Where these would ordinarily help to absorb heavy rainfall, their removal or obstruction can lead to an increased risk of surface and sewer flooding around the development. Driveways and paving systems in particular have traditionally been largely impermeable, exacerbating the issue if and when adequate drainage options are not built alongside them. SuDS are designed to mitigate that risk in a way that is kinder to the environment than any alternatives.

Rishi Sunak’s government initially proposed that SuDS would become mandatory for all new developments in England starting in 2024, following a review of the sustainable drainage provisions under the 2010 Flood and Water Management Act, as part of a broader plan to reduce sewage discharge into rivers. Given the understandable and increasing public concern in the UK’s water quality in recent years, subsequent Conservative and Labour governments did not seek to overturn this.

What This Means In Practice

  • Carrying out pollution risk assessments at all parts of the property prior to any work commencing.
  • Avoiding water flow mixing, particularly between areas with different pollution risks.
  • Dividing the area into clearly defined, separate sub-catchments, each with their own optimised SuDS, for better overall results.
  • Using porous and/or permeable surfaces and bases, such as gravel or resin-bound materials, to manage surface water runoff, reduce flash flooding, and replenish groundwater levels.
